Organizer : BIPEL, a simplified joint stock company with capital of 56,000 euros, registered with the Rennes Trade and Companies Register under number 379 085 244, whose registered office is at 27b boulevard Solférino, 35000 Rennes, France.
Purpose : The purpose of these general conditions is to define the rights and obligations of the parties in the context of the marketing of tourist services provided directly by Bayard or by partner service providers, to persons having the status of consumers or non-professionals within the meaning of the Consumer Code or travelers within the meaning of the French Tourism Code and having the legal capacity to contract.
Content and scope : These general terms and conditions of sale apply by right to the following services: packages, travel services (which may include : tourist accommodation, visits, activities, ticketing, catering, transportation, assistance, concierge services, luggage storage or any other tourist service), event organization, room rental, equipment rental, entertainment and any other services relating to the organization of conferences.
They apply for sales on the Internet or by means of other distribution and marketing channels.
Any order or immediate purchase implies unreserved adherence to these general conditions of sale, which prevail over all other conditions, with the exception of those that have been expressly accepted by the seller.
Acceptance of terms and conditions : Any payments made by a Traveler or on behalf of the Traveler (“Traveler”, “you”) to Bayard toward any Bipel tour shall constitute acceptance of all Terms & Conditions provided herein.
Payment terms : All payments shall be made on the dates indicated in the payment schedule. Late payments are subject to a non-refundable $150 fee and may result in cancellation. A Traveler registering within 30 days prior to departure must provide full payment by cashier check or wire transfer, Bayard reserves the right to cancel registrations not paid in full 30 days prior to tour departure and to charge fees per the Cancellation Policy.
Prices : If the group does not reach the size advertised, the price or programming will be adjusted accordingly. Pricing is based on exchange rates and fares applicable at the time of quotation and is subject to change. Fuel surcharges are subject to increase up to 30 days prior to departure. Bayard reserve the right to cancel any tour if the minimum number of travelers is not met. In such event, Bayard shall refund all amounts paid by Traveler.
Passport : A valid passport is required of all U.S. citizen passengers. Travelers of other nationalities should inquire with the appropriate embassies, and such Travelers are responsible for securing their own visas if required in addition to their valid passport. Travelers’ passports must be valid for six (6) months following the return date of the trip. Bayard and Bipel expressly deny any responsibility for any losses incurred due to insufficient validity of a Traveler’s passport.
Cancellation policy : All cancellation by Traveler must be notified by email at pilgrimages@livingfaith.com, or mail to this address : Bayard Customer Service Department, 1564 Fencorp Dr, Fenton, MO 63026
Bayard shall refund the following portions of the total price of a traveler’s trip based on the traveler’s cancellation during the following time frames before the scheduled departure date of the trip:
- Cancellations made 30 to 16 days prior to the departure date will be refunded 70%.
- Cancellations made 15 to 8 days prior to the departure date will be refunded 25%.
- There will be no refund for cancellations made within 7 days prior to the departure date.
In the event of the unavailability of a major component of a tourist service, Bipel and Bayard commit to offering a refund or providing an equivalent or superior tourist service. Any modification made by the retailers will be entirely at their expense.
How to register : To make your reservation, complete the Registration Form in the brochure available at www.livingfaith.com/pilgrimages, or register through this site, and submit your $500 deposit.
Registrations are sent directly to Bayard. You will receive an email from Bayard indicating you have been either confirmed or placed on the waitlist. Bayard will forward registrations and deposits for all confirmed passengers to Bipel. Final payment is due 30 days prior to departure, by April 04, 2025.
Travel insurance : We strongly suggest the purchase of travel insurance to help protect your investment in the trip and to help provide medical coverage outside the United States. We also strongly suggest you purchase the broadest coverage available with the least number of exclusions.
Health care and medical considerations : The Traveler is responsible for identifying and securing any health/medical related documentation required by the airlines and/or countries visited on the itinerary. Bayard as well as Bipel bear no responsibility for the Traveler not providing the required documentation. It is highly recommended Travelers be medically healthy and physically capable of significant walking. Our tours involve international travel to foreign countries that have different standards of accessibility than U.S. law. Transportation services, which are provided by third parties, as well as visited sites and accommodations, which are not owned, leased, or controlled by Bipel, may not be compliant with accessibility standards required by U.S. law. Despite our best efforts, some services are not accessible to people with reduced mobility. Bayard, Bipel and its service providers cannot guarantee wheelchair, motorized scooter, or walker accessibility during a trip and does not provide individual assistance to Travelers. If a Traveler requires special individual assistance, the Traveler, not Bayard, Bipel and its service providers, is responsible for bringing and paying for a capable companion willing to assist the Traveler. Subject to the foregoing, Bayard is responsible for the proper performance of the services provided for in the contract. In this context, if the Traveler encounters difficulties, Bipel or its service providers will provide appropriate assistance as quickly as possible, considering the circumstances of the case.
Itinerary : The itinerary presented in this brochure represents what Bipel is planning for this trip; however, the itinerary is subject to final confirmations and changes in local schedules. While no changes are anticipated, Bipel, at its sole discretion, reserves the right to change the itinerary, as it deems necessary or advisable. Bipel is not responsible for costs or fees related to arrangements not made through Bipel.
Final Travel Documents : Travelers receive travel documents by email approximately two weeks prior to departure.
Accommodations and meals : Accommodations are based on double/twin rooms with private bathroom facilities. A limited number of single rooms are available and are subject to a single room supplement fee. If no roommate is available for you, or your roommate cancels prior to departure, a single room supplement surcharge applies. Triple rooms are not always available and are discouraged because of cramped quarters; no price reduction for triple rooms. Meals are either menu of the day or buffet. Included meals are as shown in the itinerary.
Land only passengers : Travelers arranging their own airline ticket must meet the group at the first hotel of the itinerary.
Baggage & porterage : Baggage is at Traveler’s risk. Porterage at hotel is not included in our price for a more convenient organization of group.
Not included in the price : Passports, visas, meals and beverages not mentioned, extras beyond standard menu, baggage fees, telephone calls, laundry, medical tests, and other items not explicitly stated as included.
Photography : Bipel may take photographs or film of its trips and trip Travelers, and Traveler grants Bipel express permission to do so and for Bipel to use such Terms and Conditions (continued) for promotional or commercial use without payment of any fee or royalties. Traveler waives any ownership or publication right in connection with photographs or film taken by Bipel.
Responsibility for services: Bayard is responsible for tourist services contracted under these general conditions of sale.
Bayard, however, shall have no liability for any losses, claims or damages that are attributable either to the Customer or to a third party not involved with the provision of the travel services included in the contract or that arise out of exceptional, unforeseen or unavoidable circumstances.
The organizer is responsible for the proper performance of all travel services included in the contract. The organizer reserves the right to take action against a service provider to seek compensation if the fault is attributable to the service provider.
Limitation of the liability : The amount of any damages that Bayard may be liable to pay to the Traveler for any reason whatsoever, will be limited to three times the total price excluding taxes of the services, with the exception of bodily injury and damage caused intentionally or by negligence of Bayard.
In case of no show of Traveler on days and time mentioned on the travel booklet, and in case of non-presentation of travel document (passport, visa, identity card…) required for the departure, which prevent him to check-in, the customer cannot claim any recourse from Bayard and Bipel.
You agree that Bayard and Bipel shall in no case be liable for any damages other than compensatory damages, and your payment of a deposit on a trip indicates your agreement with these terms and your express waiver of any right to punitive damages.
Group coordinator/Spiritual leader : The group coordinator and/or spiritual leader is not an employee, agent, or contractor of Bipel. Statements made by group coordinator and/or spiritual leader are not binding on Bipel, and we will not be liable for their actions, words or promises.
Exceptional and unavoidable circumstances : Any events that create a situation beyond the control of both Bayard or Bipel and the traveler and whose consequences could not have been avoided even if all measures had been taken thus preventing the performance under normal conditions of their obligations, are considered as causes of exoneration of the obligations of the parties and result in their suspension.
The party invoking the circumstances referred to above shall immediately notify the other party of their occurrence, as well as of their cessation.
The parties shall approach each other to examine the impact of the event and agree on the conditions under which the performance of the contract shall be continued. If the force majeure event lasts for more than three months, these terms and conditions may be terminated by the aggrieved party.
Cancellation by the suppliers : Bayard or its service providers will inform you as soon as possible if a service provider needs to cancel. Bipel will also liaise between you and the service provider in relation to any alternative arrangements offered by the supplier.
Dispute Resolution/ Limitations of Damages : These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts without regard to conflict of law principals. Any dispute arising out of or relating to these Terms and Conditions that cannot be resolved amicably between Bayard, Bipel and a traveler shall be litigated in the courts of the Commonwealth of Massachusetts, County of Worcester, or, if it has or can acquire jurisdiction, in the United States District Court for the District of Massachusetts.
